ACCUMAX Auto Parts, Inc. of Joplin, Missouri (“ACCUMAX”) (Tel: 417-624-8886) and Eada Company, Inc. of Thousand Oaks, California (“Eada”) (Tel: 805-480-9139), manufacturers and suppliers of high quality automotive electrical parts, including starter drives, solenoids, switches, and etc., are pleased to jointly announce that a settlement has been reached between them and Wetherill Associates, Inc. of Royersford, Pennsylvania (“WAI”) in a federal court lawsuit in Los Angeles, California. WAI, who purchased Ace Electrical Acquisition, LLC (“Ace”) through bankruptcy and trademark infringement against ACCUMAX and Eada in connection with certain products that were previously sold by Ace under Ace’s “Accurate” label. ACCUMAX and Eada denied any wrongdoing, and denied the allegations and claims of WAI.
Under the terms of the settlement agreement, the lawsuit (including all of WAI’s claims against ACCUMAX and Eada) has been mutually dismissed with prejudice, and there are absolutely no restriction or limitations of any kind on the activities of ACCUMAX or Eada.
Joe Hsieh, President of ACCUMAX and Eada, state: “I am very pleased with the settlement and dismals of the lawsuit and of WAI’s claims, which means that this legal dispute is now behind us, and it will not result in any disruption to our business. As always, ACCUMAX and Eada will continue to concentrate their efforts to deliver high quality auto electrical parts and components to our valued customers.”
Robbie Sullivan, General Manager of ACCUMAX, voice similar sentiments: “I am extremely happy that the lawsuit with WAI is over, that the claims have been dismissed, and that the lawsuit did not result in any restrictions or changes in our business activities. I am thankful to all of our customers for trusting the ACCUMAX name and the good folks behind it, and for helping us grow since this company was formed in 2004. ACCUMAX and its employees are committed to providing the best quality products and customer service to the automotive electrical rebuilding industry.”
ACCUMAX and Eada were represented in the subject lawsuit by their intellectual property law attorney Kamran Fattahi of the Law Office of Kamran Fattahi in Encino, California (Tel: 818-996-0015).
